LightCo Pty Ltd – Terms of Service 

Overview 

This website is operated by LightCo Pty Ltd, an Australian-owned and operated company. Throughout this site, “we,” “us,” and “our” refer to LightCo Pty Ltd. 

By accessing our website or purchasing products, you agree to be bound by these Terms of Service, including all policies referenced herein. These Terms apply to all users, including browsers, customers, designers, contractors, resellers, and content contributors. 

Continued use of the website after changes to these Terms constitutes acceptance of those changes. 

 

Section 1 – Website Use 

  • You may browse this website for information about LightCo products and services. 

  • You must not modify, distribute, reproduce, transmit, or otherwise use any content from this website without written permission. 

  • LightCo makes no warranties regarding accuracy, completeness, or reliability of the website content or linked sites. 

  • We are not liable for any direct, indirect, incidental, or consequential damages arising from website use. 


Section 2 – General Conditions 

  • We may refuse service to anyone at any time, for any reason. 

  • You agree not to reproduce, copy, sell, or exploit any part of the Service without written permission. 

  • Headings are for convenience only and do not affect these Terms. 


Section 3 – Accuracy of Information 

  • LightCo makes reasonable efforts to ensure accuracy but does not guarantee product descriptions, specifications, pricing, or other content are current or complete. 

  • Images, drawings, dimensions, and promotional materials are illustrative only and may change without notice. 


Section 4 – Product Availability and Pricing 

  • Prices are subject to change without notice. 

  • Delivery charges are excluded unless stated on the invoice. 

  • Fittings exclude globes unless stated otherwise. 

  • LightCo may limit quantities of products supplied. 

  • Errors and omissions excepted (E&OE). 


Section 5 – Orders and Billing 

  • LightCo may refuse, cancel, or limit orders at our discretion. 

  • Customers must provide accurate and complete purchase and account information. 

  • Notification may be attempted if orders are modified or cancelled. 

 

Section 6 – Delivery and Shortages 

  • Shortages or missing items must be reported within 48 hours of receipt. 

  • Claims for incorrect pricing must be reported within 14 days with invoice number and item codes. 

 

Section 7 – Returns 

  • Returns require prior approval and a Goods Return / Replacement Approval. 

  • Original invoice number must be quoted. 

  • Faulty or damaged goods must be returned via a LightCo representative or nominated carrier. 

  • Return shipping for faulty goods will be covered by LightCo; all other returns are the purchaser’s responsibility. 

  • Additional conditions: 

  • A minimum 25% restocking fee may apply to cancelled orders of specially imported products. 

  • Some items cannot be returned. 

  • Approved returns may be issued as credit note, replacement, repair, or refund depending on circumstances and ACL compliance. 

  • Items sold as ex-display or ex-sample are not eligible for return or refund. 

 

Section 8 – Damaged Goods 

  • Claims for damaged goods must be reported within 7 days of delivery. 

  • Failure to notify within this timeframe may affect claims, but your rights under ACL are not limited. 

 

Section 9 – Retention of Title 

  • All goods remain property of LightCo until payment is received in full. 

  • Until full payment: 

  • Purchaser holds goods as trustee for LightCo. 

  • Goods must be stored separately and clearly labelled as LightCo property. 

  • Proceeds from resale must be held in trust for LightCo. 

 

Section 10 – Warranty 

  • LightCo light fittings carry: 

  • 24-month warranty for residential applications 

  • 90-day warranty for commercial applications 

  • Warranty covers defects in workmanship and materials if: 

  • Installed by a qualified electrical professional 

  • Voltage supply is within the specified range 

  • Product is not misused, damaged, or improperly installed 

  • Warranty does not cover globes or light sources. 

  • LightCo’s liability is limited to repair or replacement of defective components. 

  • Labor, installation, or re-installation costs are covered only if approved in writing. 

 

Section 11 – Exclusions and Limitations 

  • This warranty is the only warranty provided. 

  • To the fullest extent permitted by law, LightCo excludes all other warranties including: 

  • Implied warranties of merchantability 

  • Fitness for a particular purpose 

  • Suitability or condition of products 

  • Where ACL prevents exclusion, liability is limited to repair or replacement where permitted. 

 

Section 12 – Intellectual Property 

  • All names, logos, trademarks, and materials on this website are owned or licensed by LightCo. 

  • Use of trademarks or content without permission is strictly prohibited. 

 

Section 13 – User Submissions 

  • Except for personal information collected under the Privacy Policy, all communications or materials submitted are non-confidential and non-proprietary. 

  • By submitting content, you grant LightCo the right to use, reproduce, publish, or distribute the material. 

 

Section 14 – Third-Party Links 

  • This website may contain links to third-party websites. 

  • LightCo is not responsible for content, accuracy, or practices of third-party sites. 

 

Section 15 – Disclaimer of Warranties 

  • Website use is at your sole risk. 

  • The website is provided “as is” and “as available” without warranties. 

  • LightCo does not guarantee uninterrupted, secure, or error-free service. 

 

Section 16 – Limitation of Liability

  • Our goods come with guarantees that cannot be excluded under ACL. 

  • You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
